Mom charged with murder after son, 10, shoots teen neighbor

A mother has been charged with murder after her 10-year-old son shot and killed a teen girl over the weekend.

Forty-year-old Elaina Gomez-Villeda was arrested and charged with several counts on Sunday, Albuquerque police said on Facebook.

Dispute over loud music

Dig deeper:

On Oct. 31, Gomez-Villeda had allegedly gotten into a physical altercation with the victim’s, 16-year-old Keinerlein Rangel, mother over loud music, according to a KRQE report.

Kienerlein attempted to stop the fight when Gomez-Villeda allegedly instructed her son to get her handgun.

The boy then returned with the handgun and allegedly shot once, hitting and killing Kienerlein, police said.

Gomez-Villeda then brought her son back inside their home and allegedly texted her husband saying, “I’m probably going to jail right now.” She then called 9-1-1 to report the incident.

During the 9-1-1 call, a man, who was believed to be Kiernerlein’s father, allegedly attempted to open Gomez-Villeda’s door and broke a window.

Gomez-Villeda then allegedly shot at the man in an attempt to make him leave, KRQE reported.

No charges for 10-year-old

What we know:

Gomez-Villeda has been also been charged with conspiracy to commit murder, child abuse, contributing to the delinquency of a minor, battery and receiving a stolen firearm, according to the Bernalillo County jail inmate website.

What we don’t know:

The 10-year-old who allegedly shot Kienerlein is not being charged at this time, but that could change.

Detectives and the district attorney’s office, as well as state officials, are working to determine how to charge a minor.
